Construction Board of Appeals

About

The SMBA construction board of appeals can be called to hear and decide appeals of orders, decisions, or determinations made by the building official relative to the application and interpretation of the governing code. The construction board of appeals consists of members who are qualified by experience and training to pass on matters pertaining to building construction and are not employees of SMBA.

How to Apply

  1. Complete the Application Form.
  2. Submit the completed application form along with the non-refundable $500 application fee to the Authority.  Note: You must also include five (5) copies of all supporting documentation with your application.  If you choose to submit electronically, you may be billed for the cost of duplication in accordance with our fee schedule.  Any documents submitted to the SMBA Building Board of Appeals shall be considered public documents and are subject to the provisions of the Freedom of Information Act, PA 442 of 1976, MCL 15.231 et seq.
  3. Once your application & documents have been received, we will work with you and the members of the board to determine a meeting date and time in accordance with the Open Meetings Act, PA 267 of 1976, MCL 15.261 et seq.
  4. After the meeting, a decision letter will be issued by the board of appeals to the applicant.
  5. You have the right to appeal the decision of the Southwest Michigan Building Authority Building Board of Appeals to the State of Michigan.  If you choose to appeal the decision, you must make your application to the state within 10 days of the Authority’s decision.
